A New Wave of Scrutiny for Shein
The announcement from the Texas Attorney General on December 1, 2025, is perhaps the most substantial and definitive US action thus far in any of the legal squabbles. The investigation pertains to product safety, wage pay, and data privacy – three domains where international regulators have previously voiced concerns. The study additionally comes firmly placed under “Make America Healthy Again”, sparking a resistant grin at the great motion of falling imports and wafting the rising anti-discomfort wave over the de minimis lawsuit.
This global moment matters. For two years, authorities across Europe and Asia have cited risks tied to Shein’s operations. Texas is now adding a U.S. state-level layer to that expanding landscape.
Concerns Over Product Safety
Regulators in multiple jurisdictions have questioned the safety of certain Shein products. South Korea’s Ministry of Environment published results throughout early–mid 2024 showing excessive levels of lead, phthalates and formaldehyde in children’s items and fashion accessories. In several cases, chemical concentrations were far above local legal thresholds.
The European Commission’s Safety Gate alerts have also listed Shein items for chemical and physical risks. These listings have accumulated over the past several years and continue to appear intermittently. Each alert requires product removal, but the recurrence illustrates ongoing issues with quality control.
Texas investigators now want to determine whether similar safety issues affect goods sold into the U.S. market. The state will examine materials, documentation, testing compliance and consumer disclosures.
Labour Practices Under Investigation
The Texas probe aims to understand whether Shein’s sourcing practices align with the claims it makes to consumers about responsibility and ethical production. The investigation considers whether misrepresentation of labour conditions could fall under consumer protection laws.
Public Eye’s 2021 investigations have taken up cracks in the system, conveying the image of unbearable working conditions in Guangzhou’s garment-manufacturing plants, toiling Shein’s wares under toil. A follow-up investigation thus sought to investigate claims of unlawful overtime practices being actively exploited in these places and to evaluate the real impact of the current interventions or the implementation of the intervention measures.
Provided that the investigations included are stringent, the Texas AG has not yet compiled a list of suppliers from its end. The Texas State AG office will evaluate Shein for proper supply chain transparency, considering conditions observed in an audit and whether anthropocentric marketing claims really correspond to the audit.
Data Privacy and Cross-Border Compliance
The data practices of Shein are under scrutiny due to extensively personalising millions of app consumers via data. A review of Shein’s adherence to obligations under the Texas Data Privacy and Security Act, introduced in July 2024, is now being undertaken by Texas.
What this investigation will try to look into is how the user data is collected, processed, stored, and shared, along with being shared with the users. Different privacy laws in the U.S. require international platforms to follow different legislation. The scope of Shein protecting itself before different states—which are now Texas and California—remains vague at present.
France Escalates Regulatory Action
French oversight intensified in 2024 when lawmakers advanced penalties targeting fast fashion, including advertising restrictions and environmental surcharges. These measures did not suspend Shein’s marketplace at that time.
Two months later, in November 2025, French authorities took the extraordinarily direct approach of instigating steps to suspend Shein’s marketplace. The lawbreakings on the platform concerning firearms and hyper-sexualised childlike dolls of third-party sellers were discovered shortly before. The investigation focused on whether the protections put into place by the governance structures of Shein were enough to prevent such listings. With reference to Shein, this meant it being identified immediately as a retailer while also receiving scrutiny for operating a large e-commerce platform.
Europe’s Continuing Attention
Within the EU regulatory structure, Shein is monitored under the Digital Services Act as a Very Large Online Platform. This designation requires enhanced transparency in content moderation, data usage and algorithmic processes.
Safety authorities across Europe have also continued to flag Shein items for chemical and safety concerns. These combined pressures reflect a broader trend of European agencies taking a more active role in policing cross-border e-commerce.
Shein Issues a Response
In a statement announced on December 2, Shein commented on the probe by Texas. The company has indicated its readiness to engage constructively with Attorney General Paxton while it restated its commitment to compliance and transparency. The statement thus clearly shows a change from earlier reports that the company had been unresponsive.
The statement contains no new information about planned reforms or internal measures but does signify cooperation.
Shein at a Global Crossroads
A lot of regulatory issues have had a global reach, as almost any violation has happened in a lot of countries. All the companies under Shein cannot very easily show what is working for the brand; the results of monitoring of the brands; the terms and conditions other than on-site; and definitively documented compliance with transparency. This scale really proves that one needs regular reporting, verifiable audits and reporting of audits to the regulators and the involvement of the regulators in discussions on matters of a regulatory nature.
The brand’s rapid growth puts all these systems under pressure. Whether Shein decides to strengthen its global compliance infrastructure or simply take on issues ad hoc will shape its future, especially if reports suggesting the company might still make haste to list in the United States are accurate.
